Allahabad High court bans sand mining by JCB machines

Allahabad Hight court has ordered ban on use of JCB machines for sand mining.

 

The court pointed out that as per the Supreme Court's guide lines and model rules, sand mining from Ganga and Yamuna rivers can only be carried using human resources.

 

In its verdict the Allahabad High Court said, "These rules apply to all lease holders. Sand mining from river cannot be done using machines."

 

However, it overruled the verdict given by the Lucknow bench of Allahabad High Court that approved sand mining using small machines.

 

The bench of Justice Arun Tandan and Justice Sunita Agarwal of Allahabad High Court gave this verdict while taking a final call on a petition filed by the environmental activist Durgashankar of Banda district.

 

Durgashankar had filed the petition against the ongoing sand mining on the bank of Ken river. The petition pointed that mining done by machines affects the underwater creatures as well as the atmosphere.
